New FMLA Regulations: What You Should Do Now to Get Ready. On November 17 2008, the Department of Labor released new final rules interpreting the Family and Medical Leave Act (FMLA) that took effect on January 16, 2009. These rules provide new rights and responsibilities - some of which will help employers in controlling and administering FMLA leave. Employers need to understand what they need to do both to be fully compliant with and to take full advantage of the benefits of the new FMLA landscape. Changes to the ADA - Are Your Accomodations Reasonable? The ADA Amendments Act (ADAAA) went into effect January 1, 2009. The amendments incorporate major changes to the definition of the term disability, dramatically expanding coverage of the law, and changes reasonable accommodation obligations for an employer. As a result of this legislation, more employees will be qualified as disabled and entitled to reasonable accommodations. Employers will need to hone their reasonable accommodation skills and processes in light of these dramatic legislative developments.
