California and Michigan Courts Examine Recovery of Lost Future Royalty Damages
In a recent case from California, a federal trial court in California re-examined an issue that was central to a headline-making decision from the state courts of California in 1996. In July 2003, the U.S. District Court for the Southern District of California addressed whether a franchisor could seek compensation for future lost royalties from a franchisee after the franchise agreement between the two was terminated. FTC Staff Speaks Out On Earnings Claims Made in Internet Advertising

On January 29, 2004, the FTC franchise rule staff issued a new advisory opinion (FTC Staff Advisory Opinion No. 04-2, available at http://www.ftc.gov/bcp/franchise/advops/advis04-2.htm) thoughtfully addressing the subject of earnings claims and internet advertising.
